Horizon Cargo and Trade LLC Terms and Conditions
1. General Terms
- Acceptance of Terms: By using our services, you agree to comply with and be bound by these terms and conditions.
- Modification of Terms: Horizon Cargo and Trade LLC reserves the right to change these terms at any time. Any changes will be posted on our website.
2. Services Provided
- Scope of Services: We offer a wide range of import, export, logistics, transportation, and distribution services.
- Service Limitations: Our services are subject to availability and may be limited by factors beyond our control.
3. Shipping and Handling
- Packaging Requirements: All items must be properly packed to ensure safe transportation. We are not responsible for damage due to improper packaging.
- Prohibited Items: Items such as firearms, explosives, narcotics, and other restricted goods are strictly prohibited.
4. Customs and Duties
- Compliance: Customers are responsible for complying with all applicable customs regulations and for paying any duties or taxes that may apply.
- Documentation: Accurate and complete documentation must be provided for all shipments.
5. Liability and Insurance
- Limitation of Liability: Our liability for any loss or damage to shipments is limited to the value declared by the customer, up to a maximum of $100 per shipment unless additional insurance is purchased.
- Insurance: Customers are encouraged to purchase additional insurance for valuable items.
6. Claims and Disputes
- Claims Process: Claims for loss or damage must be submitted in writing within 30 days of delivery. Claims for non-delivery must be submitted within 90 days of shipment.
- Dispute Resolution: Any disputes arising from these terms and conditions will be resolved through arbitration in accordance with the rules of the American Arbitration Association.
7. Privacy and Data Protection
- Privacy Policy: We are committed to protecting your privacy. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.
8. Governing Law
- Jurisdiction: These terms and conditions are governed by the laws of the of United States. Any legal action must be brought in the courts of United States.
Balikbayan Box Rules
- Eligibility:
- Only Qualified Filipinos While Abroad (QFWA), such as Overseas Filipino Workers (OFWs), Non-Resident Filipinos, and Resident Filipinos, can send balikbayan boxes.
- Duty and Tax-Free Privileges:
- Balikbayan boxes containing personal effects and household goods not exceeding PHP 150,000 in value are exempt from duties and taxes, provided they are not intended for sale, barter, or trade.
- This privilege can be availed up to three times in a calendar year.
- Prohibited and Regulated Items:
- Prohibited items include firearms, explosives, narcotics, and other restricted goods.
- Regulated items may require permits from relevant authorities.
- Packing and Documentation:
- Items must be securely packed to prevent damage during transit.
- A detailed list of contents and their values must be provided.
Personal Effects and Household Goods Rules
- Eligibility:
- Returning residents and Filipino nationals who have stayed abroad for at least six months can avail of duty and tax-free privileges for personal effects and household goods.
- Duty and Tax-Free Privileges:
- The total value of goods must not exceed PHP 150,000 per shipment.
- This privilege can be availed up to three times in a calendar year.
- Prohibited and Regulated Items:
- Prohibited items include firearms, explosives, narcotics, and other restricted goods.
- Regulated items may require permits from relevant authorities.
- Documentation:
- A detailed list of contents and their values must be provided.
- Required documents include a completed Personal and Household Effects Declaration Form, a photocopy of the biographical page of the passport, and any relevant invoices or receipts.
- Approval from the Department of Finance:
- To qualify for tax and duty-free importation, written approval from the Department of Finance is required, which can be secured either before departure from your country of residence or within 60 days upon arrival in the Philippines.
